Terms of Service
Effective August 29, 2026
1. Service
Local Care provides software for home-care agency operations, including worker and member management, scheduling, visit documentation, EVV-related workflows, authorization tracking, billing support, onboarding, compliance tracking, and related administrative tools. The service is software only and does not provide medical, legal, billing, employment, or clinical advice.
2. Agency responsibilities
Your agency is responsible for the accuracy of information entered into the service, determining which laws, payer rules, EVV requirements, employment rules, privacy obligations, and professional standards apply to your operations, and reviewing information before relying on it for payroll, billing, claims, care decisions, or regulatory submissions.
3. Accounts and authorized users
You must keep account credentials secure and provide access only to authorized personnel. You are responsible for user roles, worker and member access, and activity performed through accounts controlled by your organization. You must promptly remove or restrict access when a person no longer requires it.
4. Privacy and sensitive information
You may use the service to store sensitive personal and health-related information only as permitted by applicable law and your agreements. Where a Business Associate Agreement or other data-processing agreement is legally required, it must be executed separately before using the service in a manner that requires that agreement.
5. Trial and paid service
New agency accounts may receive a limited free trial. A trial may expire unless a paid plan is selected. Paid plans, included features, usage limits, billing frequency, and prices are the terms displayed in the current plan catalog or otherwise agreed in writing at the time of purchase.
6. Acceptable use
You may not use the service to violate law, access another organization's data without authorization, interfere with service security, introduce malicious code, misrepresent identity or authorization, or use automated means to defeat access controls.
7. Availability and changes
We may maintain, improve, or modify the service over time. We aim to provide reliable access but cannot guarantee uninterrupted operation. Features may depend on third-party services such as identity, email, payment, mapping, or storage providers.
8. Ownership
Your agency retains rights to the data it submits, subject to the rights needed for us and our service providers to host, process, secure, back up, and transmit that data to provide the service. The software, design, documentation, and platform technology remain the property of their respective owners.
9. Suspension and termination
Access may be suspended or terminated for nonpayment, material security risk, unlawful use, abuse of the service, or material violation of these Terms. Data export or retention rights after termination may be limited by the applicable plan, law, or separate written agreement.
10. Disclaimers and limitation
The service is provided on an as-available basis to the extent permitted by law. Agencies remain responsible for reviewing calculations, reports, exports, AI-assisted output, and operational recommendations. Nothing in the service guarantees payer acceptance, regulatory compliance, reimbursement, or a particular business outcome.
11. Updates to these Terms
We may update these Terms as the service evolves. Material changes will be communicated through the service or other reasonable means. Continued use after an updated effective date constitutes acceptance where permitted by law.
These service terms are intended to describe the product relationship and should be reviewed alongside any signed order form, Business Associate Agreement, data-processing agreement, or other written agreement that applies to your agency.
